California Senate Bill 127 would require licensed psychotherapists to make a report to local law enforcement electronically, within 24 hours, in a manner prescribed by the Department of Justice, about a person who has communicated to the licensed psychotherapist a serious threat of physical violence against a reasonably identifiable victim or victims.
So far, California Senate Bill 127, which was introduced by Senator Ted Gaines, a Republican from District 1, has been amended twice. The only statute being affected by California Senate Bill 127 is Welfare and Institutions Code § 8105(c) to delete “immediately” and to add “electronically, within 24 hours, in a manner prescribed by the Department of Justice.”
As reported out of the Senate Committee on Public Safety reviewing California Senate Bill 127 as last amended April 1st, Senator Gaines has indicated he will propose an author’s amendment in committee to delete the electronic reporting requirement for licensed psychotherapists and leave it only for law enforcement.
