Our review of the annotated history reveals the following legislative history (every “c.” below represents a separate legislative bill):

Added: 1997, c. 867
Amended:
•  1998, c. 423: in subdivision (e)(2)(B), substituted “horse races” for “horseraces”; and added subdivision (g) relating to collection of player fees.
•  1998, c. 424: deleted subdivision (f) and redesignated subdivision (g) as subdivision (f).
•  2001, c. 941: rewrote subdivision (f).
•  2003, c. 756: in subdivision (e)(1), inserted “poker or Pai Gow game, and any other other [sic] game played with cards or tiles, or both, and approved by the Division of Gambling Control, and any”; and rewrote subdivision (f).
•  2004, c. 405: in subdivision (e)(1), made a nonsubstantive change to delete the duplicated word “other” following “and any other”.
•  2005, c. 546: rewrote subdivision (d).
•  2007, c. 176: in subdivision (e)(1), substituted “Department of Justice” for “Division of Gambling Control”.
•  2007, c. 493: in subdivision (f), substituted “five” for “three” in two places.
•  2008, c. 509: in subdivision (e)(2)(A), inserted “326.3 or”.
•  2011, c. 15: in subdivision (a), amended the introductory clause by deleting “the state prison or in” after “imprisonment in” and adding “or by imprisonment pursuant to subdivision (h) of Section 1170”.
