Our review of the annotated history reveals the following legislative history (every “c.” below represents a separate legislative bill):
Added: 1970, c. 581 (as § 1283)
Amended:
• 1970, c. 1045: substituted “limitations” for “imitation” in (a); and “for discovery” for “, whether for discovery or as evidence, or both,” in (e)
• 1976, c. 1185: Deleted the former second sentence in (e) which read: “Such leave shall not be granted unless it is impractical or impossible to obtain the attendance of the witness at a hearing, or it is grossly inconvenient, uneconomical, inefficient, or otherwise unjust to refuse such leave, having due regard to the importance presenting the testimony orally at a hearing”
• 1998, c. 931: Amended (a) by deleting “in a civil action” after “arbitration were pending”; and adding “in a civil action other than a limited civil case” after “superior court of this state”.
• 2004, c. 182: substituted “Section 1985) of Title 3 of Part 4, and in Title 4 (commencing with Section 2016.010) of Part 4” for “Section 1985) of, and Article 3 (commencing with Section 2016) of Chapter 3 of, Title 3 of Part 4 of this code” in (a).
