Our review of the annotated history reveals the following legislative history (every “c.” below represents a separate legislative bill):
Added: 1872 Civil Code codification (derived from Field’s Draft of NY Civil Code § 1861)
Amended:
• 1979, c. 373: Nonsubstantive code maintenance bill (deleted references to sections “3344, and 3345 of this code”)
• 1992, c. 469: designated the existing text as subdivision (a), in subdivision (a) inserted “of this code, the Eminent Domain Law (Title 7 (commencing with Section 1230.010) of Part 3 of the Code of Civil Procedure)”, substituted “include” for “be”, substituted “that wrongful” for “such”, inserted “the reasonable cost of repair or restoration of the property to its original condition,”, and added subdivisions (b)(1), (2).
