Our review of the annotated history reveals the following legislative history (every “c.” below represents a separate legislative bill):
Added: 1989, c. 795
Amended:
• 1993, c. 1072 (S.B.743) – broadened the scope of the section to provide additionally for physicians and surgeons, rewrote the penal provisions of subd. (b), redefined sexual contact, and added subds. (e) and (f)
• 1994, c. 146 (A.B.3601) – nonsubstantive changes to maintain the code
• 1995, c. 444 (S.B.685) – inserted “, or alcohol and drug abuse counselor” throughout the section; in subds. (b)(1) to (b)(4), relating to penalties for violation of subd. (a), substituted “or by both that imprisonment and fine” for “or both”; inserted subd. (c)(2), defining alcohol and drug abuse counselor; and redesignated as subds. (c)(3) and (c)(4) former subds. (c)(2) and (c)(3), defining sexual contact and intimate part, respectively.
• 2011, c. 15 (A.B.109) – in subd. (b), in pars. (3), (4), and (5), substituted “pursuant to subdivision (h) of Section 1170 of the Penal Code ” for “in the state prison”.
